It is increasingly challenging to define the concept of justice. That said, justice implies having the freedom to make rational decisions relating to human life. Administration of justice entails sustaining the societal structure and functioning in harmonious operation. Justice describes social institutions and other critical social players’ roles and responsibilities within the criminal justice system. The term system is crucial in understanding different dynamics, including the administration of justice organizations, the legal procedures’ design, and justice services. The justice system encompasses different areas and specialties. The term administration is connected to formal organizations or social systems in general. In this essay, I defined the concept of justice administration and derived my worldview about the subject of administration of justice organizations. In this regard, the administration of justice organizations should be anchored on legitimacy, governance, and innovation.
The Concept of Justice Administration
According to Guimaraes, Gomes, and Guarido (2018), administration of justice is a hypothetical domain and study techniques and methods tailored to appraise administrative procedures linked to the articulation as well as utilization of social resources, institutions, and knowledge, at diverse levels of the legal system, including how they influence the delivery of justice within a given societal dimension. That said, the justice system comprises different organizations that play a vital role in delivering justice based on their respective obligations, including consumer advocacy entities, notaries, conciliation and mediation bodies, and professional associations (Guimaraes et al., 2018). Many justice organizations, including the law enforcement agencies, correctional services, and courts, are highly legitimated and institutionalized, thus creating an impetus for the citizens to take them for granted.
Legitimacy
Legitimacy is key to the administration of justice organizations because it describes the relationship between authority and consent. An individual’s decision to disobey authority is centered on the rightfulness concept, or instead of a “recognized claim of right” to support deference. In this context, the functioning of justice organizations, including courts, is anchored on social acceptance. It is increasingly challenging to support social organizations as inherently illegitimate or legitimate entities. It follows then that specific dimensions are instrumental for justice organizations to build legitimacy, including the court design, the motivations of judgments, the global dimensions of particular laws, and the implications of the justice organization’s performance in terms of upholding the rule of law (Guimaraes et al., 2021). Therefore, the administration of justice organizations such as courts requires cultivating citizens’ belief in the institution’s capacity to stamp its authority based on the rule of law.
