Introduction
With the increased bed bug infestation in the recent past across different states in the nation, there has arose a need to address this problem and different states have come up with laws addressing the same (Maestre, 2011). This paper will consider five different states and how they put their legislations. These are: Minnesota, New Hampshire, California, Florida and West Virginia.
In Minnesota State, the law of bed bugs requires that motels, hotels, lodging houses among other facilities to be put up be equipped in such a way to prevent bedbug infestations. It also allows such facilities to make use of licensed exterminators in certain given circumstances. On the other hand, the State of California requires that beds in hotels supplied to renters be clean and free of bedbugs and changes in the linens each time a new occupier acquire the occupation of those premises. Motel and hotel bedding must be changed every time a new client occupies them.
Florida State has come up with legislation that requires landlords to make necessary and reasonable measures for extermination and eradication of bedbugs within their rentals. Unlike in Florida, the State of Arizona which considers bedbugs as a public nuisance harmful to public health in any hotels and motels prohibits towns and cities from controlling landlord-tenant bedbug regulations but allows them to control the disposal of bedbug infested items. It, therefore, means that the boards of supervisors can only regulate the disposal of bedbug infested items but not the landlords nor tenants. Furthermore, this State obligates the tenant to provide educational materials related to bedbugs (Oklahoma State University, 2012).
West Virginia State requires that any motel, hotel and other facilities for renting to the public infested with bedbugs be disinfected, fumigated and renovated completely until all the bedbugs are eradicated. New Hampshire, on the other hand, requires landlords to shun all the premises infested with bedbugs if they fail to conduct a regular inspection and a programmed remedy. The owner of the restricted hotels and motels may stop any tenancy by giving the lessee a notice in writing to cease those premises upon failure by the owner to prepare remedy for the infestation. The cost of remedy for the infestation will be borne fully by the tenant who may however recover those costs only if the infestation was caused by the tenant (Sam, 2011 p. 45).
New Hampshire State further requires the lessor to act promptly without disappointing to tenant’s claim on bedbug infestation within his premises. The lessee is also obligated by the bedbug law in New Hampshire State to allow the owner access to the hotel room, motel and other premises to carry out an evaluation on whether there are bedbugs present especially after the owner is alarmed about their presence by other tenants.
