Introduction
When applying for school enrolment in the United States, individuals provide information about their racial and ethnic background. The federal government uses this information to monitor discrimination and segregation and determine how to allocate federal aid. The federal agencies have used standards set forth by the Office of Management and budget to collect and present information on individuals' race and ethnic backgrounds (Martinec, 2015). The discrete racial categories include American Indians, Asians, Blacks, Whites, Hispanics, and Non-Hispanics.
Classification of Students
Following the landmark judgment in Brown v Board of Education, the federal government required school districts to conduct mandatory desegregation, which brought about the classification and assignment of learners based on race as a way of complying with the orders. Classification of learners enhances racial balance among K-12 learners (Martinec, 2015). Thus, school integration could bring an end to the existing disparities in the education sector. In Brown v Board of Education, the Court stipulated that separate schools for blacks and whites created inequality among K-12 learners.
Legal Issues Surrounding the Classification
The mandatory requirement to desegregate district schools led to various legal issues. One of the legal issues that arose from this was the resegregation of schools due to societal factors. Several district schools in urban centers had a higher number of minority learners. The school districts attempted to solve this problem by using the race strategy (Anderson, 2015). The race-conscious assignment plan was challenged in the Parents involved in the community Schools v Seattle School District. The Court's judgment required race and socioeconomic status in classifying diversity instead of race alone. These strategies enabled the school districts to prevent desegregation.
The other legal issue that resulted from the classification of students for racial balance among K-12 learners was the de jure segregation. The classification of students as a way of enhancing racial integration legally allowed the separation of learners.
