Introduction
In this assignment, you’ll need to decide whether Paula Plaintiff has any legal claims arising from another series of unfortunate events. After reading the scenario, answer the questions that follow, making sure to fully explain the basis of your decision.
Paula’s bad luck continues. Five days after the events detailed in your last assignment, Paula returns to work at Capstone Corporation. Unfortunately, she used her company e-mail to send her mom a personal note about her injuries, despite being aware that Capstone’s company policy prohibits use of company e-mail for personal communication. Paula’s supervisor, Mikey Manager, discovers Paula’s violation and Paula is reprimanded. When Paula goes home, she uses her personal computer to post disparaging comments about her boss and Capstone Corporation on social media. The next day, Paula is fired from her job.
After several days of bad luck, Paula believes her luck is about to change. She finds a new job in a nearby town. Paula had been using the bus to go to work at Capstone Corporation, but she will need to purchase a car to commute to her new job. Fortunately, her neighbor Freddy Ford has just purchased a new vehicle and is selling his old Mustang. Paula meets with Freddy and agrees to purchase the Mustang for $1000. The parties also agree that Paula will bring Freddy the money the next day when she picks up the car. The next day, Paula calls Freddy and says, “I have the money. I’d like to come pick up my car.” Freddy replies that Paula is too late. He sold the car earlier in the day.

The rights and freedoms of individuals in different countries or jurisdictions around the world play a significant role in guiding the daily interactions and integration across the social, political, and economic dimensions. The interactions and integration of countries at the bilateral or multilateral levels, for instance, are often guided by set principles and guidelines agreed upon by all the parties involved. Individual countries, on the other hand, have unique ways of doing things that function to promote justice for all while also protecting the rights and freedoms for its citizens. The unique way of doing things across the social, political, and economic dimensions builds on what is right or morally acceptable in society. Contradicting the acceptable way of doing things is considered illegal, immoral, or infringing on the rights and freedoms of other members of society. These principles or legal provisions that guide people’s interactions and integration across the different dimensions in society form what is commonly referred to as the constitution. The constitutional provisions of a country further form an effective basis for the development and implementation of diverse policies by other jurisdictions, such as local authorities and business organizations within the nation. Issues such as privacy at both the individual and collective levels of society and the use or the respect for other people’s property are characteristic features of the constitutional provisions guiding the formation of company policies. Provided herein is the evaluation of two scenarios involving three parties and a comprehensive analysis of the same based on the constitutional provisions and guidelines on such situations.
Paula’s interaction with her former employee, Capstone Corporations, makes for one of the scenarios involving or rather raising various legal issues for constitutional analysis and evaluation. According to the scenario, Paula is culpable of using the company’s resources for personal use against Capstone Corporation’s policy on the same. Upon her return to the company, Paula uses the company’s email system to communicate with her mother about personal injuries. The use of company email for personal use is prohibited by the organization’s policy on the use of its resources by employees. Paula further goes ahead to use her social media platforms to make and post disparaging comments about her supervisor at Capstone Corporation, which leads to her dismissal from work.
It is evident that the company’s code of conduct and its internal policies prohibited the wrongful use or misuse of its resources by the employees. The company exercised its right to protect its property from misuse by other individuals or employees by formulating policies to guide the conduct and interaction of employees within the organization. Capstone Corporation’s policy on the use of company email, for instance, served to regulate or monitor employee’s communication in relation to the demands of their work assignments.
