Introduction
There is more than one thing that could go wrong in the event of a training session. As such, the trainers have to stay vigil at all times to make sure that they are on the right track, otherwise everything from planning to implementation of the training plan could go south pretty fast (Noe, 2010). Most of the trainers understand the aspects that relate to conducting successful training sessions, however, majority are not keen or aware of the legal issues that relate to the aspects of training. This is a clear indication that everything in a sovereign country is controlled by the law. As such the trainers need to understand and become familiar with all the requirements that relate to professional practice and standards to avoid litigation.
Legal issues in training
One of the legal issues that the trainers have to be aware of is the fact that they need to be certified by a reputable organization. This is to ensure that the training and the material related are not in violation of any laws. Ideally this means that both the trainers and the organization they are working for have been certified to operate (Noe, 2010). Different areas of training require certification from varying organizations. By making sure that, the trainers and the organization is certified, there are less chances of getting lawsuits. Today, lawsuits can come from any direction as most people understand and follow the legal system guidelines and thus, the rate of litigation has also gone up. It also means that the trainers and their organizations become more competent.
The Tort Law is one other aspect that every trainer should be aware otherwise they could end up paying dearly for avoidable mistakes. This is a law that mostly relates to wrongful acts that may not involve the breach of the contract between the training body and the company in question. In most of the cases, the Tort Law comes in where the trainer or the training organization has been reported to show signs of negligence in their duties. At the same time, if the work delivered is deemed to be below the generally accepted standards, this could also surmount to a civil lawsuit. In the event that the trainer or the training firm is caught up in a lawsuit, one of the first aspects that are going to be assessed is with regard to the qualifications of the trainer and the organization (Noe, 2010). At the same time the documents that were signed by the trainer and the company that had hired them, would also be scrutinized.
