The definition of a right, a legal right, a moral right, a human right and how they are related
A right refers to a person’s entitlement to something, whether to concepts such as due process and justice or towards the ownership of property or some interest in the property, personal or real (Velasquez, & Velazquez, 2002).
On the other hand, refers to the entitlement that is derived from a specific legal framework that allows a person to act in a particular manner that will require other people to act in a specific manner towards that person
However, moral or human rights are emphasized as the most fundamental rights since all people are privileged to these rights by being human beings (Velasquez, & Velazquez, 2002). Regardless of jurisdiction, gender, nationality, religion, ethnicity or any other status, all people are equally entitled to their human rights without being discriminated.
A right, legal and moral or human rights are all related since they allow people to decide freely whether to pursue specific interest or activities while simultaneously being protected (MacKinnon, & Fiala, 2014). Additionally, these rights indicate the absence of being reprimanded against the pursuit of specific interests or actions and therefore, they provide a person authority or power in doing something to safeguard their interests or those of others.
Velasquez, & Velazquez, (2002) stated that legal rights normally confer towards entitlements only where the particular legal framework is being enforced by the legislature. Moral rights typically confer to entitlements to every individual, regardless of the legal framework.
Features that define a moral right
A moral right can be defined through the use of three features which are:
Moral rights are directly linked with duties which mean that the moral rights if an individual is rooted in the moral duties of another person or an organization to which the individual is associated with owing towards a shared interest or outcome (Mandal, 2010). Additionally, it is the moral duty of any person to think and act for the beneficence and prosperity of the organization they serve for the sole purpose of attaining specific actions on the part of the company in accordance to the moral rights of the person.
Moral rights provide people with autonomy and equality while pursuing personal interests. If a person has the moral right to pursue a specific curse of action, then that should not interfere with the moral rights of another individual or organization (Velasquez, & Velazquez, 2002). A person has the right to pursue their interests as long as they do not impede the rights of others.
Moral rights can be utilized in justifying a person’s actions or towards invoking the protection or assistance of others (Mandal, 2010). An individual with strong social values can use moral rights to object to harmful public acts and an attempt to stop the action with the assistance of the police and other people. This means that the person can invoke the help of others to aid him in doing so with full moral justification (MacKinnon, & Fiala, 2014).
