Lisa and Danny are neighbors that live on Guerrero Street. Fifteen years ago Lisa built a gazebo. She frequently used the gazebo, but she was not aware that actually the gazebo was on property belonging to Danny. A month after the gazebo was built Lisa built a fence between her and Danny's yard, and the gazebo was on Lisa's side of the fence. Fifteen years later, Danny has a survey done, and he discovers that the gazebo is on his land. Danny brings a suit to evict Lisa from the land. Does Lisa have a defense? Assume that the state in question has an adverse possession period of ten years.

Trespassers can go into somebody’s land, occupy it and legally possess it. Trespassers can acquire large quantities of land or property through this process. So if someone is using your property even in small quantity, you need to be attentive and act fast because as time goes by, that person continues to get enough reasons to legally own that property. Moreover, a trespasser would receive a licensed right to legally utilize someone’s property, this process is known as adverse possession.
The doctrine that allows people to possess or become owners of other people’s property is known as “adverse possession,” (Klass, 2006) Although the name sounds criminal like, the end result of it can also be, the trespasser does not intend to commit any criminal activity but is because of the circumstances. The trespasser could have made a mistake in the first place for occupying somebody’s property illegally. A person who occupies somebody’s property may recall owning it. During this process of identifying who legally owns that property, some ends in courts when one identifies that somebody has been occupying his property without his consent. Or when one tries to get a title protection for his property, the title protection agency may refuse to grant one when they identify that the property is on somebody’s property. If those who are involved and concerned about the issue do not solve the issue, the owner may sue the trespasser or trespasser raise a lawsuit requesting the court to settle who owns or should own that property.
