It is justifiable to detain people in jail before their trial. If the accused is not detained, they might leave and hide secretly. Releasing the accused gives them freedom; this freedom enables them to run away and not even appear to the trial. The accused may also fear being jailed and might run away and hide. In addition, releasing the accused may obstruct the investigation. The accused may obstruct the investigation by interfering and giving out bribes to the witness, thus complicating the whole case leading to a lack of the required evidence. If the defendant is released, they can continue committing other offenses or continue with crimes. When the accused is not detained, they may continue with crimes that may be more harmful. Therefore, releasing the accused may end up causing more harm than good. Releasing the accused people is risky because it can cause public disturbance (Jones, 2018 p.1063). If the criminal was reported by the public, they can keep disturbing the public and can even get revenge. The detainee should be protected from public anger, and hence they should be detained. People who are victims of crime tend to have too much anger towards the criminals, and if the criminals are realized can be harmed or even killed by the public.
Pretrial detention unfairly discriminates against the poor. The cash bail issued by the courts is too expensive for the poor. However, the rich afford to pay the cash bails, and hence they are not always not detained...
