The NYPD has been proactive in ensuring that more marijuana arrests happen. They search pockets and possessions for marijuana. Here, people are stopped on the streets, frisked and searched. Those found in possession of even small amounts of marijuana are arrested and prosecuted. The police indicate that the marijuana was open to the public view. The move to reach out to peoples’ pockets is a failure since it is illegal for the police to reach inside an individual’s pockets without any “probable causes.”
The major motivation for the numerous marijuana arrests is for the police officers to prove their high productivity. The emergence of professional policing has caused police departments to measure police productivity using the number of arrests (Siegel, 2017). Further, marijuana arrests are critical in increasing overtime pay for officers.
