During a debate or a protest, individuals are protected by the first amendment when they practice their freedom of speech without causing major disturbance and substantial disruption. In this case, the student from Oregon High practiced his freedom of speech without interfering with school activities or violating the right of other students. The court highlights that the t-shirt constituted a political speech on an important matter migration which is a public concern. In addition, besides exercise of freedom of speech through t-shirt offending a few student, the speech did not initiate damages or raise the level of tortious conduct.
