Under the Exclusionary Rule, any evidence obtained in violation of the defendant's 4th Amendment cannot be used in the criminal trial. For example, if a police officer without a warrant or probable cause opens the trunk of a car and finds 10 kilograms of cocaine, this evidence cannot be used to prosecute the driver. The driver is obviously involved in drug trafficking activities, but it would be difficult to get a guilty verdict without the 10 kilograms of cocaine.

The exclusionary rule essentially protects an individual from illegal searches and seizures that police officers might do. It also prevents them from using such illegally acquired evidence in a court of law (Hughes, 2013). This rule needs to be carefully handled and understood to prevent apparent criminals from hiding behind it. In other terms, the rule can prevent justice from being done or makes it quite complicated to be administered, just because of the notion of ‘illegal search.’ I like the fact that there are exemptions to the rule, such as the doctrines of plain view and the inevitable discovery doctrine (PowerPoint Presentation). However, officers still need to find a way to make decisions based on their judgment while still working within the confines of the exclusionary rule.
