• If you were the prosecutor in this case, what crimes would you charge against Smith?
• If you were Smith's attorney what defenses would you raise based on these facts?

If I were a prosecutor, I would charge Smith with larceny. As earlier noted, larceny is the fraudulent or unauthorized taking of someone else’s property (Scheb, 2014). Their actions at the scene prove they were out to commit larceny. If I were Smith's attorney, I would try to argue that my client had not committed any act of larceny since larceny involves taking away property unlawfully, yet my client had not done so. Moreover, I would argue that the property was still right within the owner’s premises.
