A tort in medical practice implies a wrongful act that an individual (physician or any other health care professional) commits against another (patient). The torts system helps establish whether or not a physician made a medical error. The tort system is tailored to deter negligence in medical practice by punishing negligent healthcare providers monetarily and compensating the harmed patients with those proceeds. Torts support the litigation system by discouraging negligence practices in medical practice, exacting corrective justice, and compensating those harmed by negligent acts (Sohn, 2013). On the other hand, negligence implies a civil wrong due to the failure of a physician or health care provider to exercise the duty of reasonable care under the law with specified circumstances. In this way, it can be inferred that the negligence and torts system supports the physician-patient interactions in a healthcare setting to enhance treatment and overall health outcomes. When a patient approaches a physician for medical care or treatment, they do so hoping that the provider will use their skills and knowledge to alleviate their pain and suffering and relieve their health problem (Harris, 2014).
