Procedural Facts of the case and an overview of what happened
The case is Summers v. Tice, which reached the California Supreme Court on 17th November 1948. Both the Plaintiff and the defendants carried some weapons and proceeded to a hunting trip. The plaintiff showed the defendants the right directions on the way they should safely fire their guns without hurting people. In the process where the defendants were shooting, they aimed poorly as defendants fired their weapons to the direction of the plaintiff injuring the plaintiff on the right eye and the face. The plaintiff ended up using the two defendants in the account of negligence. The trial court judged the case to favor the plaintiff. The Supreme Court of California further bestowed the plaintiff damages for the injuries that he suffered from the incidence and the court made a judgment on the negligence of duty by the hunters who are the defendants of the case.
Sensitive Facts of the case
One of the sensitive facts of the story is that the plaintiff had not given the two defendants substantial knowledge yet on how they should use their weapons. In defense of the defendants, the shooting was accidental, and it was not the negligence of duty as they were not yet equipped with adequate expertise in handling the weapons.
Issue
The issue of the case is on timing. Timing happens to be an issue as the hunters never had substantial skills to handle the weapons. The plaintiff never ensured that these two defendants were psychologically ready to handle the weapon as not being ready creates susceptibility for accidents.
