The plaintiffs were indigenous Mayan Q’eqchi’in Guatemala, El Estor. They alleged that mining companies that were under Canadian control, Hudbay Minerals and its wholly-controlled subsidiaries, committed human rights violations in Guatemala including, shooting, killing and gang rape within the mining project vicinity. The plaintiffs brought three disparate actions that arose from acts of violence connected to mining operation not in favor of mining company, subsidiary as well as businesses which had merged with mining company (Pena, 2014).
The case involving Margarita Caal Coal versus Hudbay Minerals Inc. was brought by eleven women against HMI and Hudbay Minerals. The plaintiffs affirmed that on 17th January 2007, they were all gang raped by mining company officers, police as well as military as they were being forcefully removed from their Lote Ocho village, requested by the Canadian mining company (Thomson Reuters, 2014).
