Standard of care in the medical community can be simply defined as the accepted guidelines for treatment of a condition or disease by health practitioners. Malpractice, on the other hand, is failure to observe the agreed and accepted standards (Kjervik & Brous, 2010). It is usually used in a court of law to determine whether the medical practitioner accused of malpractices is guilty or not. In the case of Yolanda Pinellas, it is evident that some malpractices were committed during the time that she was in hospital. Some of the violations included inefficient communication, lack of proper assessment training, failure to observe the outlined health procedures, improper use of a medical device and lack of proper patient supervision. Other malpractices included understaffing, lack of proper supervision of medical personnel and causing the nurses to work under fatigue.

There was, therefore, a strong case against the nurses in charge of the patient as well as the health institution. It is evident that there was neglect in connection of the infusion pump to the patient’s body. There is proof that the nurse had not carried out proper procedures in treatment of the patient and did not observe the accepted standards of care. In addition, communication was not quick and efficient enough to provide an immediate response to the situation. Instead of finding an immediate solution to the problem, the nurse was concerning in stop the beeping produced by the infusion pump. In the end, Pinellas developed necrosis of the hand which in turn led to the loss of her career. It should be noted that nurses should at all times be in constant observance of the patient assigned to them. This ensures that there is quick response to such an emergency as the dislodging of the IV.
