Introduction and the Main Issue
In the Alford v. Collins-McGregor Operating Co. case, some landowners sought one of the most remarkable judgments in the history declaring that the oil and gas lease for their land would not be valid since the lessee had failed to develop the resource and could not bring any positive changes in the formation of the Gordon Sand. According to Cecil O. Alford and team, they wanted to create restlessness for the lessee and thus opted for some meaningless strategies to prove their claims. Earlier this year, the Ohio Supreme Court made several big announcements, one of which was that there would not be any implied covenant for exploring the apart and separate from the implied covenant of the reasonable development (Alford et al., 1991).
Discussion
During the hearing, in their error assignments, the landowners argued that the trial court had completely ignored their requested and tried to favor the lessee unnecessarily. They got angry at this and decided to bring the case to the high court. Eventually, the Ohio Supreme Court began supervising the entire case, and it still ruled against those landowners and favored the mineral interest holders, helping them get out of the uncertain situation. The case remained in the court for quite a long time, and hearings were done on a regular basis. Initially, the judge looked confused about whom to favor, but finally, the Ohio State took a wise step and began favoring the lessee (Alford, 2009).
