Understanding the different legal mechanisms and safeguards that could be used to protect one’s business is essential for any business owner. It allows him to have greater vigilance about his rights and focus more on improving his business as the risks of other entities grabbing his idea would be mitigated. In this article, the author would like to focus on analyzing the different intellectual property protection mechanisms in the UAE to improve the security of its startup business Easy Go. This includes insight into the various state agencies that could be of use in this process. All in all, the author believes that filing for both patent and design rights would be most beneficial for this startup business.
Analyzing Various Property Right Protection
One of the IPR mechanisms that could be used to protect EasyGo is a patent, which has a term of protection for about 20 years after the date of its filing. In UAE law, patents apply to those inventions or innovations created with an “inventive step and capable of industrial use or exploitation” CITATION Mon201 \l 1033 (Mondaq.com, 2020). In other words, a patent is mainly useful to tangible (and at times intangible) assets that are innovative from the previously existing reiterations of a commodity and has a high probability of being commercialized or used for the purpose.
In line with the startup idea, it could be seen that EasyGo would utilize new roving, digital, and automated cashless terminals that would allow its clients to purchase products wherever it goes. However, Amazon has also implemented their cashier-less terminals, the integration of various functions and features that comprise a more innovative and automated grocery shop warrants the ‘innovative step’ required to file a patent CITATION Int201 \l 1033 (International Trade Administration, 2020).
Additionally, the author believes that this kind of IPR protection mechanism would be more appropriate and beneficial than Trademark, Design Rights, and Copyright.
