Anti-Kickback Statute
The Anti-Kickback Statute (AKS) criminalizes the exchange of anything of worth for referrals of businesses eligible for reimbursement under healthcare programs. Unlawful kickbacks include collecting monetary rewards for referrals, receiving free or meager rent for office properties, and an extravagant salary for medical executive positions. Kickbacks have resulted in higher healthcare expenses and professional decision-making malpractice (Moses, 1, p. 1). Fines of up to $25,000 and exclusion from Medicare and Medicaid care programs are possible punishments for breaching the AKS.
Patient Safety Rule
The Patient Safety Rule creates a structure in which healthcare facilities, practitioners, and other medical providers can freely send information to Patient Safety Organizations (PSOs) to integrate and analyze safety events on a confidential premise (Ulrich, 2, p. 2). The Office of Civil Rights is in charge of interpreting and enforcing the privacy safeguards outlined in Subpart C. The Agency for Healthcare Research and Quality (AHRQ) listed and delisted PSOs mentioned in Subpart B.
