In reality, no country can be governed by regulations or constitutional laws regardless of the type of governance. For instance, individuals who engage in capital crimes are punished by the death penalty. Everyone has the right to life and law enforcers should ensure that all citizens are protected. The paper answers two primary questions as discussed below.
Answer 1
Juveniles or intellectually disabled people who commit capital crimes should not be executed. Capital crimes are those that put individuals’ lives in danger and might include treason, rape, robbery, murder, and genocide among others. The Supreme Court of the United States of America (USA) has made it clear that juveniles and intellectually disabled individuals are less culpable.
Moreover, it is against the USA’s constitution to impose capital punishment on intellectually disabled people and juveniles. For example, in 2012, James Holmes killed twelve individuals at Aurora Colo., Movie Theater (Dewan). However, a jury did not give the death penalty to this person since he was mentally sick for an extended period. That does not mean that mentally ill people are allowed to commit crimes, but rather they should be taken to places they can get proper mental health care. When it comes to juveniles, they should not be sentenced in the same way as adults.
Nevertheless, the determination of whether the defendant’s intellectual disability contributes to the commitment of capital crimes should be determined by the jury. Based on the principles of criminal law, the only way to mitigate culpability is through diminishing a person’s decision-making capacity (French 6). Intellectually disabled individuals and juveniles should not be held to similar standards to those of adults. The decision-making capacities of these people are diminished and they are less likely to resist coercion.
