The Legality of Debt-Related Imprisonment in the United States
Alongside bail and parole, probation allows for the suspension of an offender’s sentence and admits them back to the community as they inculcate good behaviors while under strict supervision outside the prison. However, while bail is often a monetary incentive to return to court, parole involves the release incentive for an offender’s good behavior. If convicted defendants are unable to provide a monetary incentive to return to courts, then they are housed in jails as inmates. A majority of them are often unconvicted defendants awaiting trial, with an exception of convicted misdemeanants and felons already serving their jail terms. Jails differ from prisons in the sense that they refer to places for persons awaiting trial or those held for minor crimes (HG.org np). On the other hand, prisons are places for persons convicted of serious crimes and this sets jails and prisons apart from bail and probations as they require one to be found guilty of crimes.
