Felony Offenses and Bail
In every civil law, there is a common presumption that every person presented before the court of law, a suspect or accused, is innocent until proven guilty. The court is therefore required to prove beyond no reasonable doubt that the accused committed a crime or not before making a final judgment. In regards to this, the accused has the privileges of being granted bail, terms varying depending on the seriousness of the case. This, however, raises questions on its appropriateness given there is an option of putting the accused on a preventive dentition.
Bail naturally discriminate against the poor and favors those who can afford to raise bail, and in the quest for justice for all, bail should not be an option in the first place (Dabney et al. 7). Offenders of serious crimes who can afford bail pose a serious threat to the community and even themselves in case of retaliation from the offended. Perpetrators of violent crimes have a probability of committing a subsequent serious offense even during the bail term.
