The Islamic Republic of Afghanistan’s constitution was approved on January 4 2004 in Kabul by an assembly that comprised of 502 members and it created a nation that pledged to be Islamic and democratic. Therefore, according to their constitution, Islam is the supreme religion of the country, but adherents to other religions can freely worship in the country. In this regard, the Afghan constitution is similar to the United States’ first amendment that demands that no law in the country should prohibit the free exercise of religion.
However, while the Afghan constitution provides strong guarantees of religious freedom, it still declares Islam as the state’s sole and official religion. It further indicates no laws should contradict Islam’s belief and provisions, and there are other laws discriminating against religious minorities. For example, it declines the registration of non-Muslim marriages unless they consent to an Islamic. Hence, in this case, the Afghan constitution differs from the United States constitution that allows freedom of not only religious worship but also practices within the country.
