Each student is responsible for two things: preparing a written summary of the case, which is due on the date the case is discussed in class, and leading the discussion of the case in class. Each half of the assignment is equally important. Students should check the syllabus to see when their case is scheduled and should use the format for this assignment provided under the Assignments link in Blackboard. If you do not sign up for a case, or if you do not attend class on the date your presentation is due, you will receive a zero for this assignment.
Assignment Submission: All course assignments, including extra credit, are to be submitted in paper format. Emailed submissions will not receive credit, and they will be deleted when received without further response or advice. In the case at hand, the parties involved include Warren Park Partners Limited, General Electric (GE) Financial, and Silverman and partners. In particular, Silverman and partners were the ones who signed a guaranty. They unconditionally, irrevocably, and absolutely agreed that the principal amount and interest would be repaid on time. As such, if Warren Park Partners Limited defaulted to pay the borrowed amount of money on time, GE would demand that money from Silverman and partners. The court hearing this case was the United States District Court of Northern Illinois. The facts are that Warren Park Partners Limited borrowed a loan from GE to purchase land in Frisco, Texas. Silverman and partners were the ones who signed a guaranty where they agreed to be held responsible if the debtor failed to repay the loan on time. Additionally, Warren Park Partners Limited went bankrupt and was unable to raise the money for repaying the loan at the agreed time. The primary legal dispute, in this case, are the affirmative defenses of theft, economic coercion, theft, extortion, and fraud that were filed by Silverman and partners. If the defendant proves these allegations, they would have mitigated the legal consequences of GE unlawful conduct.
Whenever there are affirmative defenses, the court must take time to establish whether they have proper grounds or not.
