1. What is the intent and purpose of HIPAA?
The core purpose of the HIPAA is ensuring that patients’ confidential information and personal data is kept safe and away from access from unauthorized people (Alsaadi, Qasaimeh, Tedmori, & Almakadmeh, 2020). This involves ensuring that such data and information is safe from unauthorized access in healthcare facilities and organizations, as well as protecting it from access from third parties such as cybercriminals and thieves. HIPAA also holds individuals and healthcare organizations accountable for any case of patient data and information breach.
2. Explain the concept of Protected Health Information (PHI).
Protected Health Information (PHI) refers to any piece of information in which the medical records of an individual which was created, used, or disclosed in their course of diagnosis or treatment which can be used in identifying them at a personal level (Koch, 2016). The meaning of PHI also encompasses a broad range of identifiers as well as the different information which was recorded and stored during the entire course of the patient’s treatment and then their billing. The retrieved information shows the questions asked to the patient and the responses they provided, as well as the charges imposed on them for the services rendered (Kocabas & Soyata, 2020). Collecting such PHI is important and it is one of the core components of the healthcare sector since it enables identification of patients using their information and data as recorded and stored during their diagnosis process. As such, there is a need to ensure that PHI is attended in consideration with the appropriate safeguards.
3. What impact can the breach of PHI have on patients/consumers?
Breaching PHI has various consequences on the parties involved, and the individual perpetrating such vices could land a jail term. However, patients feel the most impacts of the breach. In most cases, by the time that organizations discovered that a form of medical identity theft (a form of PHI breach), the damage is already done on the patients and it may never be recoverable (Jiang & Bai, 2019). In this case, forty percent of patients who have been subjected to any form of PHI breach claim that they found out that they have been subjected to such medical identity theft after receiving a collection of letters from different creditors or expenses which the thieves had incurred in their names. Consequently, they undergo severe consequences due to the PHI breach, and resolving such cases becomes stressful and expensive for them as they have to meet the costs incurred by the thieves.
