In today's fast-paced world, advancing technologies in nursing care have caused ethical and legal dilemmas in privacy and patient care management. The healthcare industry is deeply rooted in professional ethics and the legal structures of HIPAA to safeguard and protect patients' information from authorized access. However, with the influx of technologies, promoting ethics, values based on data integrity, confidentially has become a challenging task. This essay explores the diverse ways advancing technologies in the healthcare system negatively affects patients' privacy and management.
New and emerging technologies have caused a drastic increase in patient privacy and HIPAA standards violations. In the recent past, the US Office for Civil Rights has been vocal in reporting HIPAA infractions affecting the public domain of 500 people or more (Colorafi & Bailey, 2016). Failure to abide by the set policies in the patient privacy and HIPAA standards provokes immediate discontinuation of care, affecting patient recovery rate. Also, existing literature shows that failure to harmonize technology with the existing health regulations contributes to the non-HIPAA compliance practices. In this light of approach, experts state that the technology that aids standardized nursing care will threaten patient management.
Furthermore, studies show that a significant percentage of new and emerging technologies are not consistent with the legal structures of the health organizations. As a result, these technologies cause healthcare providers to fall out of HIPAA compliance. Violation of patients' privacy creates distrust between the patient and the healthcare provider (Rouleau, Gagnon, & Côté, 2015).
A nurse may face HIPAA violation charges by releasing patient information to an unauthorized person to aid in an ongoing succession court case.
