In the court case AT&T Mobility LLC V. Concepcion Et Ux, the customers collectively sued the service provider citing their advertisement as fraudulent despite prior agreement to settle conflicts via arbitration. While the defendant called for enforcement of arbitration agreements, both the District Court of California and the Ninth Circuit Court of Appeal denied the motion for the AT&T Mobility. AT&T Mobility contract terms regarding arbitration of disputes were guaranteed only on the condition that the customers present their arguments individually and not as a group. The contract also allowed for amendments to be made by the AT&T Mobility without the consultation of the customers. These privileges that AT&T Mobility enjoyed over the contract terms appeared to be one-sided and therefore the courts made the right decision to deny AT&T Mobility motion to ensure justice for both parties.
