Legal System
The role of a legal system is to ensure that public and private disputes are resolved using the set procedures and rules. They ensure that legitimate processes are followed in the dispensation of justice and that both parties understand the gravity of presented matters and acknowledge the past sentences (Farrow, 2013). There are numerous judicial systems across the globe, and each has a unique set of procedures and rules to be followed. Each system is independent, and the only documents that almost all courts subscribe to are the human rights charter drafted and passed by the United Nations. Each jurisdiction follows its unique set of rules, and professional bodies are usually set up to help in the representation process. There are numerous legal professional bodies, and they include judges, lawyers, solicitors, and paralegals. Each of them has unique roles in the justice system, although sometimes their roles are complementary. However, they are all expected to be professional in the dispensation of their duties by understanding the parameters of operations.
Paralegals have a unique duty from lawyers, and they are instrumental in the judicial system. They are required to offer guidance to their clients when they are facing charges of minor offenses. Their limit of representation lies in the expected sentence if their clients are found guilty of offenses and the sum of money to be paid. They are also confined by the types of courts they can appear in and the type of cases they can represent their clients. Their services can be concentrated in small claims courts; tribunal works that touch on various issues in the public concern, traffic courts, and minor offenses. Unlike lawyers, they have numerous restrictions, and they are only bound to clients depending on the types of cases they have and the level of courts they appear in.
Alternative Dispute Resolution (ADR)
Tribunals are an important part of the justice system, and they operate within varied parameters depending on the jurisdiction in question. They offer justice in the form of alternative dispute resolution that lies outside the mainstream court system. How tribunals are established in countries like America, Britain, or Germany are different from how they are established in Canada. They also operate within preset conditions, although they are allowed to be flexible in both constitution and operation in some cases. In Canada, each province can have different tribunal operation parameters, and they can also vary depending on the type of case being presented. In Ontario, tribunals are groups into 14 lots, each working on different types of cases, although they all have the authority to determine the outcome of cases. They include Animal Care Review Board, Assessment Review Board Child and Family Services Review Board, Custody Review Board, Criminal Injuries Compensation Board, Fire Safety Commission, Landlord and Tenant Board, Human Rights Tribunal of Ontario Licence Appeal Tribunal, Ontario Parole Board, Ontario Civilian Police Commission Ontario Special Education Tribunal (English), Social Benefits Tribunal and Ontario Special Education Tribunal (French).
