Common law entails collecting court decisions that English courts, Singapore superior courts, and courts from other counties developed. The countries, which have adopted the system of common law are the ones that were previous protectorates or former British colonies, such as the United States. Since a common law system is less prescriptive than a civil law system, a government can enshrine citizens’ protection in specific regulations related to infrastructure programs. Common laws significantly influence the decision-making process in various unusual cases, if it would be complex to decide about written rules of law or existing statutes. The high court declared common law in Singapore as uniform across all the states, which contrasts from other jurisdictions, such as the United States, with a unique common law system for each state.
The origin of the common law system is the English monarchy, which would issue orders in a formal way and writs whenever justice was needed. However, writs were insufficient to cover the various situations, which resulted in the establishment of equity courts to listen to complaints and devise remedies based on equitable principles (Ligeti, 2019). Common law in Singapore originated from the system of rules in the United Kingdom. Although there are similarities in the regulations, the influence of the U.K. common law decisions is influential in Singapore courts despite the divergence of each system (Halbert & Ingulli, 2020). Following the collection of decisions, the courts could identify precedential opinions and apply them to the current cases. Common law relies on detailed records of statutes and situations due to the lack of any official legal code applicable in a case. In most instances, such laws emerge from institutionalized opinions and related interpretations from public juries and judicial authorities.
One of the unique aspects of common law is its crucial emphasis on precedent while allowing the freedom for interpretation. The value of the legislation is that it can adapt to situations that the legislature had not contemplated. In the contemporary world, Singapore operates under a system of both common law and civil law. Although common law is derived from its original appearance in Medieval England, it is common in Singapore’s legal system. Singapore is one of the countries that has adopted common-law jurisdictions.
