Flora Tucker, a Hispanic female, applied for a sales position in Ames Department Stores in Seattle. After completing her application, she was asked to take a math test and a general aptitude test. As a result of her score, she was disqualified from consideration for the sales position. Based on this scenario, argue whether or not you believe that this testing policy is a violation of Title VII. Explain when an employer can use an Aptitude and/or other tests and how tests are validated.

In this particular scenario, there are higher possibilities of violation of the Title VII civil rights act, which was developed in 1964. Title VII prohibits employers from causing any discrimination to their employees. The discrimination can be against workers' nationality, religion, color, race, or sex (Jennings, 2017). Moreover, the act indicates that it is illegal to discriminate against an employee through testing. Hence, it is clear that in this situation, the employer violated this civil act by putting Flora Tucker in a test during the selection process (Jennings, 2017). The civil law applies to both public and private institutions. However, employees can use aptitude and tests during the selection procedures to determine the best candidate fit for the vacant post. However, these tests can only be validated if their main agenda is not associated with discrimination of people on the bases of their gender, race, or sex. Thus, unless the employer justifies the test procedure under the law, the tests and aptitudes cannot be valid.
Despite the passage the Title VII civil act for more than fifty years, employees are still facing severe discrimination issues in their place of work. Women have been the most affected since most of them suffer from gender-based violence, little pay, and sexual harassment (Jennings, 2017). In the 21st century, the Title VII act has remained irreverent in protecting employees against discrimination.
