When discussing cyber operations, Schmitt discusses the following core norms before targeting specifics objects: (1) which laws apply, (2) is the target allowed to be engaged, (3) Is the weapon legal, (4) Precautions for collateral damage, (5) and do the scope and degree of collateral damage restrict an attack against a target (Schmitt 2015, 3). These are important questions to ask against a near-peer adversary as the international community would be heavily involved in this type of conflict. He further describes the application between international and non-international actors as the difference between an organized state-like entity and a terrorist group (Schmitt 2015, 4). For example, the Russian aggression campaign would be considered international as this marked a direct conflict with another organized state while terrorist groups in the Middle East would be non-international.
One question that arises with this dichotomy is the definition of a potential China conflict with Taiwan. If China decides to use force against Taiwan, would this be an international or civil conflict? The majority of the international community does not identify Taiwan as an independent nation as they still hold the government "Republic of China", but the United States has stated their willingness to support Taiwan if conflict is initiated.
