LHh. v. Hamilton County Department of Education
L.H. is a kid with Down syndrome. L.H. went to Normal Park Grade School from 2009 to 2013. The government funds the institution and works under the Hamilton County Division of Education (HCDE). The school had an individualized training program (I.E.P.), allowing special students to interact and learn with other nonspecial peers. However, in May 2013, L.H. folks dismissed the program and transferred their child to The Montessori School of Chattanooga (T.M.S.). While L.H. was in T.M.S., his parents filed a lawsuit under 20 U.S.C. 1400, the Individuals with Disabilities Education Act (IDEA), against HCDE.
The issue
HCDE had transferred L.H. to C.D.C. at Red Bank Elementary. This platform was a separate classroom with a different curriculum for students with disabilities. HCDE teachers had identified that L.H. was not progressing according to the I.E.P. goals. More...
