Legal Cases

Lau v. Nichols

Castaneda v. Pickard

Flores v. Arizona

Plyler v. Doe

How did the legal case affect the policies and laws governing language instruction?

This decision would displace revenue that California received from the federal government. To ensure that all students receive an equitable education, the decision mandated that all money be directed toward English language learners.

A Mexican American father sought this lawsuit to obtain assistance for his two kids. His children's school district was allegedly the target of the complaint. According to the allegation, the daughters were subject to racial discrimination. There was lack of evidence of any misconduct when the issue was initially litigated. However, when it was looked into another time, there was tangible proof against the district, offering Castaneda the win. As a result of the outcome of the case, all schools are currently needed to take part in a three-part evaluation to rate bilingual education efforts and know how they will be held accountable under the Equal Education Opportunity Act.

A unique student right was the center of this lawsuit. The civil rights of kids who were English language learners were allegedly infringed in this case. Due to a dearth of educational opportunities for the pupils, there was a violation. For students who were seen to be low income and at risk, educational programs did not have language fiancé and immersion.

Based on a justification for withholding money from unauthorized immigrants in particular. Due to a lack of paperwork and confirmation of papered participants, money was withheld from several districts that housed foreign kids. The condition implied that students' rights would be restricted only when the government had a compelling reason to investigate the pupils and their backgrounds.

How will knowledge of these cases affect your future professional practice?

I will benefit in my future educational endeavors as a result of spending the time to examine these cases and learn about their origins. I believe that I now have some understanding of English language learners and their backgrounds, which will help me proceed with situations when the procedure seems to be unethical. I was ignorant of the origins of the laws or their justification, so understanding these tales has improved my ability to help my pupils of all racial backgrounds, ethnicities, and cultures succeed.

Federal Laws and Requirements

Every Student Succeeds Acts (ESSA)

Title III

Title VI

Office for Civil Rights/Department of Justice Resolutions

How did the federal law/requirement affect accountability, assessment, funding, and identification in ELL education in Arizona?

With the help of the Every Student Succeeds Act, kids may achieve achievement.
The law aims to raise the caliber of education that students receive and attain. teaching pupils the skills and resources they will need to reach the greater degree of achievement necessary to pursue a college education. This legislation was intended to demonstrate how the government will hold schools accountable for children's academic progress and how it will help ensure students' success by allowing some NCLB requirements in exchange for state-developed plans. English language learners have the chance to achieve higher education at a high standard according to the ESSA.

This support is intended to improve the academic performance and financial stability of qualifying institutions. Having this kind of financing gives school districts a method to pay for courses or programs that are seen as being STEM-based. Examples include finance, robotics, cosmetology, and car mechanics. The provision of Title III finance guarantees that English language students receive a great education. The subsidies offered are intended to help students become proficient in the English language. This assists the school in training our teachers to support ELL students.

The fact that this title prohibits discrimination against children based on race, color, or national origin in school districts receiving federal assistance is something that particularly appeals to me. TANF, EBT/SNAP, and other federal financial programs
Medicaid, among other things, has a direct impact on English language l...
