4. Strickland attempted to bribe Judge Sylvania Woods to show leniency toward one of Strickland's friends who had a case pending before the judge. Judge Woods immediately reported this to the state's attorney and was asked to play along with Strickland until the actual payment of money occurred. Strickland gave $2,500 to the judge, who promptly turned it over to the state's attorney's office. Strickland was indicted for bribery, pled guilty, and was sentenced to a four-year prison term. Three months after the criminal trial, Strickland filed a motion for the return of his $2,500. Will the court order the return of his money? 

5. Carrow owned a farm and Arnold and Mitchell, who were partners in a real estate partnership, were interested in buying it. In mid-April 2003, they met with Carrow at his farm. At this meeting, Carrow expressed reservations about selling the farm. Arnold offered Carrow $1.2 million for the farm, but Carrow declined. During their discussions, Arnold told Carrow that if he sold Arnold the farm, he could continue to live on the farm and till the land as long as Arnold owned it. Approximately a week later, Arnold and Mitchell returned to the farm and negotiated with Carrow over the terms and conditions of a sale. During these negotiations, Carrow again expressed reservations about selling the farm because lie did not want to leave it. Carrow testified that Arnold assured him that "Nothing would ever change for you, nothing...." and that Carrow could "go right on farming this farm the rest of your life...." Carrow claimed that Arnold assured him that he wanted to buy the land to use strictly as a hunting farm. He understood this to mean that Arnold did not intend to develop the property or to transfer it any time in the near future. Carrow later testified that he would not have sold the farm without these representations. Arnold admitted that during various stages of the negotiations he assured Carrow that Carrow could continue to live on and farm the land and that he would never develop it. He also agreed that he told Carrow that he wanted the land for hunting purposes. According to Arnold, however, in making this and other assurances to Carrow, he always included the qualifier "as long as I own it." After some bargaining, Carrow agreed to sell the farm to Arnold for $1.4 million, not including the farm equipment. Arnold returned to the farm and left a draft of a written contract with Carrow. Carrow put the contract on a shelf and did not discuss it with anyone for approximately one week. Although he saw provisions in the draft agreement that he did not like, he did not pay too much attention to it

Cesar Martinez Corral and Kansa Department of Labor (Plaintiff) sued Coma Corporations (Defendant) for unpaid dues. Corral is an undocumented worker who is not legally permitted to work in the United States. However, Coma proceeded to hire him, and after Corral had worked for several weeks, Coma underpaid him and eventually fired him. Corral, through the Kansa Department of Labor, wants the court to compel Coma to pay him all his dues. The court awarded Corral $7,657 against Coma and its president. Coma filed a petition for judicial review of the final order.

In determining whether to hold an agreement illegally, a court will consider the significance of the public policy involved and the extent to which enforcing such an agreement would interfere with that policy. Besides, they will consider the seriousness of any wrongdoing involved in the agreement and the direct connection between the wrongdoing and the agreement.
* APPLIED ANALYSIS
In making the decision, the courts assessed the significance of its decision and the impact it would have on the Kansas public policy of protecting wages and wage earners. As noted in Burris v. Northern Assurance Co. of America, the main goal of this objective is to protect wages and wage earners and ensure that families dependent upon them are not destitute. If the court rules in favor of Corral with the view of protecting the Kansas public policy, then it will open an avenue for more illegal immigrants to get into the country, which will be a violation of the policy on illegal immigration. Consequently, the best decision was to establish a balance by ruling the contract illegal and directing the Kansas Department of Labor to recalculate the wages at the applicable minimum wage. Therefore, the agreement between Corral and Coma was illegal because of Corral’s status, but since he had already rendered his services, he was supposed to be paid at a minimum wage rate to discourage other immigrants from accepting to work for the US companies without proper documentation.

Strickland’s case falls under the doctrine of unconscionability, which refers to terms that are unreasonable and contradict good conscience. An unconscionable contract is unenforceable because there is no reasonable or informed person who would otherwise agree to it. In such cases, the perpetrator of the conduct is barred from benefiting because the consideration provided is lacking. Trying to bribe a judge is a criminal offense and going to en extent of requesting a refund is unconscionable and hence unenforceable.
