The Return-to-Office Policy

Case Study Instructions:

Summary:
Elon Musk, who instituted a strict return-to-office policy this spring, abruptly emailed employees on May 31 that they were required to "work at least 40 hours a week in the office." However, more than three months after the resumption order was issued, Tesla still does not have enough space or resources to bring all employees back to the office
Return-to-work policies have also led to a drop in morale, especially among teams that allowed employees to work remotely as needed before Covid-19, and some employees who were previously designated as remote workers who said they could not be in the office for 40 hours a week were fired in June.
Tesla is now monitoring employee attendance, Musk and other executives receive detailed weekly reports on absenteeism.
Question 1:
The return-to-office policy -- murky and informal as it is -- has caused a significant decline in morale among some employees, considering the company by the shortage of desk spaces, parking spaces, and other resources, does this policy protect employees’ rights in general? Why or why not?
Question 2:
Before COVID-19 restrictions, Tesla managers generally figured out how much remote work was appropriate for their teams. Musk's hardline policy eliminated that freedom in theory, though some execs may still be able to carve out deals for "exceptional" employees. Does Musk's hardline policy help the company? Why does this happen or what causes it?

Question One
The return-to-office policy adopted by Elon Musk does not protect the rights of employees. On the contrary, the policy violates their rights. Employers are required by law to create safe working conditions for employees to protect them against work-related risks (Bureau of International Labor Affairs, n.d.). Musk’s strict return-to-office policy violates this right since it exposes employees to health risks. The shortage of desks, parking spaces, and other resources means that workers will spend considerable time standing or walking. Subjecting workers to such inhumane conditions could be detrimental to their health. Although the company has the power to recall every remote employee back to work, it has the mandate to create a conducive environment for them to work at their optimal best. Thus, the return-to-office policy violates the workers’ right to safe working conditions since Tesla lacks the necessary facilities to accommodate all of them.
Question Two
Musk’s hard...
