* FACTS
Dish Network, L.L.C. (defendant) gave the consent to Satellite Systems Network (SSN) as its agent to work on the best of its interest, marketing television services through direct marketing. The Telephone Consumer Protection Act (TCPA), established in 2003, prohibits calling individuals on the national Do-not-Call registry. However, the Dish Network agent kept calling Krakauer (plaintiff) solely to market their principal’s product. The calling of Krakauer was a gross violation of the TCPA act. The plaintiff sued the defendant for abusive telephone marketing practice
