The HIPAA privacy rules define the conditions that must be fulfilled for a covered entity to disclose, obtain, create or use protected health information for research activities (HHS.gov, 2016). The regulations ensure the confidentiality of individual health details while also providing researchers with the critical information needed to undertake the necessary investigations. For example, a covered entity can disclose or use the protected data with the participant’s authorization or get a Privacy Board or Institutional Review Board waiver approval.
The federal office was instrumental in determining and generating the standards contained in the research privacy rules. The Privacy Rule bases its clauses on the existing federal protection laws. The criteria of the HIPAA privacy rules are governed by the federal regulations concerning human subjects’ research and those that do not involve people (Radensky, 2003). The different States develop their Privacy Rules that must be in accordance with the federal policies.
The Joint Commission participates in the updates of the HIPAA research policies, advocating for clauses that ensure the protection of patient details and also advancing research. The agency collaborates with professionals, technical advisory panels and experts that understand the policies in the review process to offer recommendations. The body also sets some standards that aim to foster an objective evaluation of the compliance of the health care facilities regarding the research privacy rules. The body utilizes the standards to evaluate the health organization’s compliance with the research privacy policies and give accreditation (Hofman & Rose, 2014).
The joint commission seeks to enhance healthcare through evaluating the health care’s compliance to standards and inspiring them to improve the practices (Jointcommission.org, 2016). Hence, the Joint Commission must analyze the research privacy policies to ensure that the health facilities are following the regulations that the law stipulates. Additionally, the evaluation is essential for the Joint Commission to offer recommendations on ways that hospitals can improve the standards’ of implementation and enhance research.
