Separation of Powers: A System of Checks and Balances and Its Flaws
Description of Separation of Powers
Separation of powers is a doctrine of the constitutional law that provides a system of shared power between the executive, judiciary, and legislature as the three branches of the government. According to Duignan and DeCarlo (2018), the three branches have separate powers to check and balance the rest. For instance, the executive appoints departmental secretaries and judges. However, the Senate must approve the appointments. Besides, the Supreme Court can rule a law to be unconstitutional while Congress has powers of amending the constitution. The core objective of separation of powers is to prevent the majority from governing through an iron fist and provide a system of checks and balances. Since the three branches are accountable to others, no single subdivision can usurp influence to become dominant. The separation of power is key to the working of the United States government by dividing government responsibilities and providing a system of checks and balances.
Flaws of the System of Checks and Balances
The three branches of the government, executive, legislature, and legislature can limit the power of the others through a system of checks and balances. Arguably, each office checks the control of others as one of the ways of ensuring that supremacy is equal. However, the system of checks and balances complicates the policymaking process and makes it time-consuming. Therefore, the three branches might encounter a stalemate. Equally, checks and balances force the majority to accept the interests of minority groups and, thus, incompatible with democracy (Manuel, 2019). In some instances, a political awareness that lacks enough influence might make the system ineffective.
