The year is 2025 and the U.S. Supreme Court has declared all laws prohibiting discrimination in the workplace to be unconstitutional. In its opinion, however, the Supreme Court made clear that employers could voluntarily adopt policies and procedures prohibiting any and all forms of discrimination in the workplace. The Supreme Court also made clear that employers could voluntarily adopt hiring practices to diversify their workforces provided such practices did not include express preferences based upon immutable characteristics.
You have been hired as a consultant by a large, nationwide retailer to examine the business case for ensuring that all of the employee protections are found within the federal anti-discrimination laws, as well as the business case for prohibiting any other forms of discrimination in the workplace.
Write a four to six (4-6) page report in which you:
Analyze the benefits and costs of voluntarily prohibiting three to five (3-5) federal forms of discrimination prohibited under the federal anti-discrimination laws.
Discuss the benefits and costs of voluntarily prohibiting a form of discrimination not covered by any of the federal anti-discrimination laws.
State the benefits and costs of voluntarily adopting hiring and promotion practices designed to diversify the workforce.
Evaluate the ethical considerations of not voluntarily prohibiting the forms of discrimination laws examined in the first part of your report. Next, determine the ethical considerations of not voluntarily adopting hiring and promotion practices to diversify the workforce.
Provide a final recommendation to this retailer on whether or not they should ensure all, part, or none of the employee protections examined in the first part of your report. Your recommendation should also include whether or not the retailer should adopt hiring and promotion practices designed to diversify the workplace. Race
Most of the work in a retail store does not require highly skilled persons to do. The race is a lame excuse to discriminate workers because it is unlikely that for any favor you want to accord a person or deny another by sex it is unmerited. First, failing to discriminate people racially creates a good impression on the community in which the retail store is located. Positive publicity in the community is likely to increase sales relative to other stores who might be perceived by the community as oppressive to some races. An ethnically and racially diverse workforce is good publicity which helps build the brand name and drive more sales. It also saves money on marketing and fighting negative publicity. Secondly, a diverse workforce can meet the needs of every client. There is always a staff member who can connect with each client and who understands their needs.
Sex
The nature of typical tasks for workers in a retail store cannot be the basis of discriminating people along original lines. A person of any sexual orientation is capable of doing any task in which they are equally qualified as a person from another sexual orientation. The advantage of ensuring a workplace free of sexual discrimination it avoids sexual harassment as there are no people who feel objectified. Sexual discrimination fuels sexual harassment and voluntarily prohibiting sex discrimination help address possible lawsuits on sexual harassment. Prohibiting sex discrimination helps create a safe working environment for all. Avoiding sexual discrimination helps create synergy in the workplace because it feels safe and conducive for working. Workers feel that their promotions and remunerations are merited, and they are compensated fairly relative to their colleagues.
Religion
Religion has a strong influence on the people. If the workers in a particular organization notice religions discrimination, it will fuel conflict in the workplace. Most workers who observe workplace religious discrimination develop disdain and hatred towards members of other religions. In such an environment, it is difficult to work as a team and establish good professional and personal relationships in the workplace. Religion also tends to split the workers into two or more camps within the workplace along religious lines. These camps are counterproductive, and most workers spend most of their time, energy and resources in supremacy battles over whose religion is better and or superior CITATION Boo09 \l 1033 (Booth, Robson, Welham, Barnard, & Bartlett, 2009). These internal conflicts are destructive and polarize the workforce leading to poor coordination and communication in the workplace and wastefulness stemming from many workers engaging in religions supremacy battles.
