“How do the concepts of Natural and Revealed Law affect American Political Philosophy?”

 

This paper must be a 2-FULL page long (not including the title page and bibliography), in current Turabian format, with default margins and in 12-pt Times New Roman font. Paper must include citations to adequate sources supporting and/or illustrating your positions. Paper must include a title page and bibliography, also in current Turabian format.

Do not let the short length requirement of this paper mislead you. Concise writing is often more demanding than expansive writing. The goal of this paper is not merely to offer unfounded opinion or subjective discussion of the topics, but rather to provide a concise, well-reasoned analysis of the topics presented.

This is an open research project, meaning that you are expected to locate, use, and cite support outside of the course readings. Superficiality is a danger with this topic as it would be easy to write 2-FULL page without reaching the substance of the discussion. Better papers will demonstrate that you sufficiently pondered the ideas at issue to understand them, recognize them, and develop a well-reasoned approach to them.

Be sure to read closely the grading rubric for the assignment and note that at least 5 scholarly sources (peer-reviewed academic journal articles or books published by university presses) are required.

Short Research Paper 01

For Short Research Paper 01, answer the following question:

“How do the concepts of Natural and Revealed Law affect American Political Philosophy?”

Be sure to mention Augustine, Aquinas, or Maimonides (the Natural and Revealed Law philosophers), and include some excerpts of their writings from the course text with references, and include correct page numbers.

Also, include some excerpts from the writings of the American Founders, such as the Declaration of Independence, the Constitution, and the Federalist Papers.

Introduction
Natural law is basically unwritten moral principles underlying ethical and legal conventions by which we measure human conduct. These laws are put in place by nature and they help us realize the revealed laws alternatively referred to as God’s laws. However much of the literature seems to suggest that the two are joined at the hip. For the Christians, other than the revealed law, all the laws made by nature are also under God’s guidance as he is the symbol of authority and the creator of man.
Thesis statement: although the natural laws are different from the revealed law, they both have a close connection to Christian beliefs.
According to Christian ethics, "natural law theory holds that the fundamental principles of morality and legality, and hence of society, are rooted in the nature of the universe, and more specifically, in the nature of man himself they are 'rational', and that they are universal and eternal." (pg 303)[Carnes, John R. ("Christian Ethics and Natural Law." Religious Studies: 301.) 303]
This does not however underestimate the need for legislative law. In fact, as Galston states, "The (revealed) law aims both at the perfection of man's reason and at the well-being of political life, in contradistinction to (nonrevealed) laws or nomoi, which make political well-being their sole concern. (pg 28)[Galston, Miriam. ("The Purpose of the Law According to Maimonides." 69, no. 1.) 28]
Accordingly, St Augustine holds the view that God has ordained human governments that can for instance punish people for crimes for the society’s good. Augustine therefore likens defiance to authority as defiance to God. Ideally god is authority. Augustine brings out the aspect of god ordaining the laws in the society adding that governments are ordained by God. (pg 200)[Strauss, Leo. "St Augustine." St Thomas Aquinas was also another philosopher who on the other hand believed that humans learn of the reveled law by their interaction with the society. He posits that what differentiates man as a knowing being is "reason" as distinguished from "intellect" or the fact that he does not grasp the truth intuitively and all at once but arrives at it gradually through a complex rational process by means of which the mind passes in orderly fashion from known to the unknown.
