Abstract
Equality is a predefined conformity to established order or way of life. It requires absence of default social castes in the society. It is a notion much upheld in democracy. American political philosophy has transformed over the years as to accept equality as a viable option to promote the society’s wellbeing. As to achieve this, various political and economic theories were integrated for the best optimization. The American constitution is a combination of these economic and political theories borrowed from Blackstone Commentaries and early civilizations. Interpretation of the same is a determining factor in the implementation of the best political and economic synchronization. Significant aspects identified by Tocqueville reveal the growth of the American political philosophy from totalitarian principles to the principle of equality. Blackstone’s opinions through The Commentaries have received varied response from Europe and even in America. Natural law deems everybody equal and we determine our obligations, under the constituted legal channels as expected. His re-interpretation of common law provides the basis for the analysis of the American law. The systemizing of the common law, by Blackstone, fuelled the American declaration of independence and even provided a basis for the Constitution. Tocqueville, through Democracy in America establishes one of the intensive researches into the principles of democracy and their impacts on the America’s political life and how equality has materialized through the various customs, intellectual practices and even the formulation of policies. This research delves into establishing how the writings of Blackstone influenced the American Political Philosophy in general. The paper also analyses the observations of Tocqueville on the American Political life in relation to the writings of Blackstone.
The only true foundations of any society are the wants and fears of individuals.Blackstone gratified the enjoyment of individual rights as opposed to consideration of the public. Even if it is the enjoyment of public liberty- an extraction of natural liberty but constrained by artificial rules, a free government is realized by the establishment of a central place within it(Lucas 2015). Consequently, the natural desire of freedom must be supported by political art; of which has been exemplified by the American society. The adoption of an independent judiciary system, separation of the church from the state, indirect election and a free press as observed by Tocqueville constitutes Blackstone’s philosophy. The judiciary acts as a check on the unwise use of the parliament as to overstep their mandateThe American federal system provides principles such as principles of self-interest upon which an efficient democratic order might be constituted. The citizen is expected to care for and cooperate in matters within his/her scope. Supported by the civil education of the subjects, the judicial system will ensure maximum enjoyment of individual rights as proposed by Tocqueville.
