Should the U.S. Department of Homeland Security (DHS) recommend to the President and Congress to remove the Federal Emergency Management Agency (FEMA) from the DHS structure and make it an independent agency of the US Executive Branch? Discuss challenges facing FEMA responding to disasters. What strategies should be taken to lessen these challenges?
Provide a short legal brief you might submit to your superiors. The writing assignment should provide a balanced analysis of the issue assigned based on pertinent legal and other materials. The material for each assignment will come both from the required readings and outside research in order to fully assess the issues.
Technical Requirements
Your paper must be at a minimum of 3-5 pages (the Title and Reference pages do not count towards the minimum limit).

Introduction
The Federal Emergency Management System (FEMA) is a federal agency that works under the Department of Homeland Security (DHS); it was established in 1976 with a core aim to develop and implement a coordinated response to natural disasters occurring within the territory of the United States. Even though it worked as a separate federal agency between 1979 and 2003, in the wake of the terrorist attacks of September 11 and the enactment of the Homeland Security Act, it came under the supervision of DHS (FEMA, 2023). However, the recent evaluation of FEMA’s operational capacity as a sub-division of DHS has revealed that the organization faces extreme challenges in leading and implementing national disaster management strategies.
Various stakeholders and representatives tabled The FEMA Independence Act of 2009 bill to move FEMA out of DHS (Zuckerman, 2009). Proponents of the separation of FEMA from DHS argue that this move will help FEMA better coordinate its disaster management plans and tackle its failure and challenges. However, to reach a sound conclusion regarding the exclusion or inclusion of FEMA in DHS, the following report presents a short legal brief about FEMA’s challenges to settling the question regarding its future working capacity either within or outside the remit of DHS.
