Were the parties involved sued civilly?
Indeed, Facebook was sued civilly by FTC. A civil lawsuit involves one party seeking damages for the injury caused by the activity or inactions of another party. Unlike criminal cases, a civil lawsuit can be initiated by anyone, based on harm or injury suffered from an action or inaction, and the compensation of the injured party is in form of money rather than time behind bars (Hobbes, 2019). In this case, Facebook promised to only allow customers to access their friends’ information on Facebook App. However, the company allowed people using other apps to access the information of its customers. This phenomenon generated revenue for Facebook while harming the privacy of its customers. As a result, FTC, whose aim is to protect consumers, filed a case on behalf of consumers. In the end, rather than imprisoning the company’s CEO, Facebook was fined $5 billion; the largest penalty ever imposed on a firm for violating consumers’ privacy (Fair, 2019). All these factors represent a civil suit where the FTC was compensated for the harmful actions of Facebook.
What theories were or would be used to enable persons who suffered damages as a result of the conduct involved in the case to recover?
