Facts of the case
The plaintiff in the court case was Irene Morgan, an African American. White passengers boarded a bus and created some nuisance by forcing her to stand from her seat with an infant to give them the way. Nonetheless, the court case evidence shows that there were two vacant seats in the bus, but the two passengers insisted that she should stand and give them the seat. The driver requested the person and the seatmate to change their seats; however, Morgan refused and even prevented the other woman from complying (Virginia, 2016). The driver steered the bus to the jail in Saluda. The issue in the court case was about segregation based on race regarding the bus and transportation services at the time. Morgan pleaded guilty to resisting arrest but contested the segregation account where the buses could control people regarding their race.
History of the case
Regarding the case that was settled on June 3, 1946, the United State Supreme Court denounced a Virginia law that supported racial discrimination on commercial interstate locomotives. The issue was termed a desecration of the commerce clause in the Constitution (Virginia, 2016). The appellant, Irene Morgan, was travelling a Greyhound bus from Hayes Store to Baltimore, Maryland, in 1944 when she was convicted in Saluda to refuse to hand over her seat in a bus to the whites. The issue, in this case, is mainly concentrated on segregation based on color, and the black woman was trying to fight for and defend her right as an ordinary human being (VIRGINIA, 2016). Nevertheless, the case was important because it revitalized the decisions made, dating back to 1878, where the commerce clause was not supported.
