In its opinion, however, the Supreme Court made clear that employers could voluntarily adopt policies and procedures prohibiting any and all forms of discrimination in the workplace. The Supreme Court also made clear that employers could voluntarily adopt hiring practices to diversify their workforces provided such practices did not include express preferences based upon immutable characteristics.
You have been hired as a consultant by a large, nationwide retailer to examine the business case for ensuring that all of the employee protections are found within the federal anti-discrimination laws, as well as the business case for prohibiting any other forms of discrimination in the workplace.
1.Analyze the benefits and costs of voluntarily prohibiting three to five (3-5) federal forms of discrimination prohibited under the federal anti-discrimination laws.
2.Discuss the benefits and costs of voluntarily prohibiting a form of discrimination not covered by any of the federal anti-discrimination laws.

1.Analyze the benefits and costs of voluntarily prohibiting three to five (3-5) federal forms of discrimination prohibited under the federal anti-discrimination laws.
The US Equal Employment Opportunity Commission identified seven federal anti-discrimination laws. The three of these laws we will analyze are as follows:
1. Title VII of the Civil Rights Act of 1964 (Title VII), which prohibits employment discrimination based on race, color, religion, sex, or national origin.
2. the Equal Pay Act of 1963 (EPA), which protects men and women who perform substantially equal work in the same establishment from sex-based wage discrimination.
3. The Age Discrimination in Employment Act of 1967 (ADEA), which protects individuals who are 40 years of age or older.
In 2007, The Center for American Progress has identified the cost and benefits of prohibiting discrimination of gay and transgender in the workplace. I believe in this year 2025, the same cost and benefits will still be effective not only to gay and transgender discriminations but also to the three federal laws act that we will analyze. The first cost they identified that is related all three of the laws stated above is the cost of recruitment. When a company wants to stick on recruiting people based on just the certain characteristics for age, sex, gender, race, and religion, this may lead to having subpar employees that may lessen their capacity to gain big profits. The second is that their job performance and productivity will also be of poor quality because of the subpar employees. Blatant discrimination and hostility to workers not fitting the company standards of all characteristics mentioned above will also result to below average job performance at cost of the company. Third, firing them and hiring and training new ones will also cost the company which could have been better used in other business development initiatives. Fourth, consumer marketing and profits may also be affected because the cumulative spending power of gay and transgender market alone already wields nearly $1 trillion, how much more if you risk alienating the market of other race, sex, and religion? The company will loss vast amount of profits for sure. As for the benefits, we reverse all these costs and you will have great profits plus great quality employees and excellent job performance. All of the top 100 companies in the fortune magazines had adopted these anti-discrimination laws in sexual orientation and almost half included gender identity so adopting this three laws will more likely to help you be in the top companies as well (“Discrimination and Dollars, 2007).
