The International Criminal Court started operations for persecuting and prosecuting offenders who perpetrated serious offenses globally in 2002. A nation should be part of ICC rulings in compliance with the Rome Statute of the Court. The United States and Israel have not served with the ICC because they are not observers of the Rome Statute and argue that the non-Member States lack integrity. Suspects of war crimes, humanity crimes and genocide have been arrested and tried in the court. During the 20th century, several crimes were committed and went unpunished forcing the establishment of international law (Payne, Richard, 2007). Furthermore, the General Assembly of the United States also stated that such offenses need to be dealt with by an international court. The USA is the dominant government, and it should encourage conformity with human rights by promoting the ICC and by encouraging the prosecution of war criminals by courts.
Rules regulate people's behavior, and they must conduct themselves in a socially acceptable way. Laws arise out of the need to guarantee fundamental rights and freedom. The United Nations Security Council has provided support to help strengthen and improve the ICC by referring to the ICC non-member states to investigate and prosecute crimes. International law acts as a mediator between organizations, state actors, and non- state actors. Voeten (2017), stated that the law is aimed at promoting security, solving trade disputes, and also solving the conflicts of interest. The success of the international court will be achieved if all non-member state countries and member state countries will help come up with state arrests and also ensure the effective operation of the courts.
The law is aimed at protecting the values of people in case there is a violation of the rights there is intervention by the international court (Geneuss & Julia, 2017). The courts only deal with specific crimes and it levies the correct penalties to the crimes an individual has made. Through these laws, the world will be able to prevent crimes that violate the rights of citizens. During world war two, countries such as Rwanda and Yugoslavia were affected by wars between themselves, which led to the killing of millions of people. Some US citizens commit crimes, and they are not convicted since the US is not a member. US fears that the ICC can pose a threat to its sovereignty and also limit the country from exercising its powers, but that is not the case. The court's objective is to keep track of the government's activities and also persecute the US citizens involved in crimes that violate the rights of human beings (Nemane, Vivek, & Gunjal, 2015).
The court has highlighted its manifesto in the Rome Statute of ICC, and it states clearly that the court is independent, and it only presides over serious crimes. The court has conducted several cases in the past, and it was aimed at maintaining and restoring peace and ensuring that humans are protected (Henderson, Conway, 2010).
