Introduction and Summary
Social work training and an empathetic viewpoint can be useful in advocating for an individual so that they receive fair treatment (Gerdes & Segal, 2011). It follows that a mitigation report can help make the difference between a life sentence and death for someone who is traumatized or mentally ill, following bad experiences in their past. Accordingly, this paper focuses on telling a story of an individual concerning terrible events that may have influenced his criminal actions. The contents of this report are based on multiple structured clinical interviews with the client, his father, mother, sister, as well as the former and current wives, to establish his life experience. In the foregoing, the report is submitted by the request of the court where the case against the defendant was heard.
My client, a 47-year old man is soft-spoken and known by his family members and friends as a hardworking person who loves his family very much. He now faces four counts of charges including 1) A conspiracy to commit wire fraud falling under Class C Felony, with a possible jail term of not less than 20 years and a $250,000 fine; 2) Wire fraud also with a possible jail term of not less than 20 years and a fine of $250,000; 3) Aiding and abetting investment adviser fraud with a possible jail term of not more than five years and a fine of $250,000, and 4) A conspiracy to commit securities fraud through market manipulation; punishable by a jail term of not more than five years and a fine of $250,000. Based on these charges, my client was arrested on May 6, 2019, and released on an $800,000 bond, which was secured by $250,000 cash as well as strict pretrial supervision, as well as home detention and location monitoring. Additionally, my client was ordered to surrender his trial documents, restricted from making any new travel documents, tested, and treated for drugs, surrender his wife’s passport. He was then remanded into custody on October 10, 2019, following a guilty verdict.

The defendant was born on July 3, 1972, in New York City, in a family of 6, which includes his parents and three siblings. Now aged 79 years, his father is a retired pharmacologist while his mother is aged 78 years and operates a daycare center in New York. His three siblings were also born in and currently reside in New York City. His eldest brother aged 50 years works as an accountant, while his younger sister aged 35 years working as an editor at a local media house, and the youngest sibling, a brother aged 29 years, is a pharmacist. All family members are aware of the defendant’s legal situation and continually support him emotionally. Accordingly, all his court proceedings have been well attended by representatives of his family as well as friends. Moreover, the defendant continues to communicate with his family and friends through the telephone and email.
