The founders of the constitution derived it from the unwritten one that has been used by the Iroquois Confederacy that began in the 16th century. The arguments they had are tackled in this paper, even the theories, and link between native Americans and the USA’s political entity.
One of the arguments they had was they gave the government the right to control commerce, join treaty agreements, and reunite with the Indian tribes. The states were kept from making treaties, and this was the basis of an Oneida to own 6 million acres of land from Pennsylvania to Canada. The US constitution’s practices to the Indian nation were expected to be the same like how British and Europeans did.
