Introduction
It has been determined that Congress settled on matters of health insurer’s access to genetic information through the incorporation of the Genetic Information Nondiscrimination Act of 2008 also known as (GINA)(Johnston, & Pomfret, 2011). This paper, therefore, aims at explaining the purpose of GINA and the five congressional findings have impacted the creation of the final laws of GINA.
The Purpose of GINA
The Genetic Information Nondiscrimination Act of 2008 also known as GINA infers to a federal law that protects the rights of the Americans from unfair treatments that result from the differences in their DNAs that may in turn affect their health. This new law, therefore, ensures that individuals are protected from discriminations especially from their employers and their health providers (Johnston, & Pomfret, 2011).
This law was enacted to ease the concerns about discrimination that may hinder people from getting genetic tests that would also benefit their health statuses. Through this law, people are also in a position to engage in research studies without any fear of their DNA information being used against their wish either by the insurers or the employers.
GINA was enacted to provide a comprehensive protection through an approach aimed at interdicting the utilization of genetic information by the health insurers when they analyze coverage determinations(Johnston, & Pomfret, 2011). Through GINA, health insurers are therefore proscribed from making coverage determinations based on an individual’s genetic predisposition to developing future diseases. As described in Title II of GINA, it is prohibited to use genetic information in determining the employment status of an individual. Through this, employers and other entities described in Title II are restricted from requesting or purchasing genetic information that discriminates or limits an individual.
