Policy advocacy by healthcare professionals is often encouraged since they are the individuals who interact with the consumers (patients) the most. Your knowledge and perspective are vital to policymakers, as a voice for healthcare consumers and for providing validation and/or opposition to laws and policy.
In 2018, the U.S. Department of Health & Human Services announced the “Conscience and Religious Freedom Division” of the Office for Civil Rights (OCR). The office’s stated goal is to “protect institutions and people who refuse to provide medical assistance based on religious objections.” As noted by HHS (2018), the office is intended to protect religious beliefs of care providers. As with most policies, there are opponents and proponents. In general, supporters advocate that the office will protect against religious discrimination while opponents believe the bill will allow for open discrimination against women and LGBTQ patients and consumers.

Discrimination in accessing healthcare services is a global health threat. Individuals within minority groups or socially disadvantaged groups such as LGBT often face challenges in accessing health services leading to negative impacts on their health and well-being. In the United States, for example, patients have been discriminated based on their race, color, religions, immigrant status, language proficiency, affiliation, insurance status, to mention a few (Rivenbark & Ichou, 2020).
Numerous studies show experiences of discrimination, delayed or foregone care in health facilities. In the United States, for instance, significant research shows that lesbian, gay, bisexual and transgender populations encounter countless barriers in accessing healthcare. In reality, LGBT people are turned away or delayed based on their marital status (Rivenbark & Ichou, 2020). Healthcare ethics and patient’s rights advocates for all patients to seek treatments without being mistreated, discriminated, denied services based on their color, religion, social groups and insurance status (Raifman & Galea, 2018). It is annoying amidst the increased health disparities, the United States Health and Human Services introduced CRFD that increases discrimination.
Formed in 2018 by the United States of Health and Human Services, Conscience and Religious Freedom Division seeks to protect healthcare providers who fail to provide treatments that counter their religious values. The advocates of this division argue that it will help restore and enforce a nation’s law that protects the rights of conscience and religious freedom (Sofer, 2018). However, the body is preferably a missed priority as conscience related constraints have been historically low with an average of 1.25 per year (Chavkin et al., 2018). In reality, the civil rights division had rules that enforced conscience and religious freedom laws with high success rates. As such, introducing new conscience and religious Freedom Division is allowing Health and Human Services to fund discrimination at the expense of enforcing civil rights - and therefore should be discarded.
The conscience and religious freedom division opposes the United States Department of Health and Human Service mission and standard ethics of healthcare. The DHHS seeks to improve the health and well-being of all Americans through the provision of high quality, sustainable health services (Raifman & Galea, 2018). Similarly, the standard medical ethics calls for respect, justice and service delivery to all patients regardless of the social, political, and religious backgrounds (Hanák, Ivanová, & Chráska, 2019). While advocates consistently claim this body will offer providers with satisfying spiritual lives, it is baffling which religion would forbid a provider from providing healthcare for patients that come before them.
